Chicago: Comstock and Souferis Awarded Defense Verdict in Professional Negligence Claim
In September 2018, HPS attorneys Tom Comstock and Bill Souferis won a defense verdict for a hospital and registered nurse. The plaintiff alleged that the defendant hospital, through its agency relationship with its nurse, breached the applicable standard of care in failing to properly assess her when she presented to the hospital’s emergency department back in September 2013. Plaintiff generally claimed that the defendant nurse was professionally negligent in her triage assessment and failed to take adequate precautions to prevent her injuries.
The defendants argued that the nurse properly assessed the patient within the standard of care and denied all claims of professional negligence. The defense further argued that the nurse’s alleged breach was not the proximate cause of the plaintiff’s injuries.
The jury deliberated for less than an hour before returning a verdict in favor of the defendants.
