Chicago: HPS Defense Victory for Orthopedic Surgeon in Cook County

Partners David Hall and Tom Comstock successfully defended an orthopedic surgeon, in a Cook County case.  At trial, Plaintiff contended that HPS's client was negligent in transecting two tendons during an arthroscopic ganglion cyst removal procedure.  The Defense team argued that injuries to adjacent structures, including tendons, were known complications of the arthroscopic procedure.  The Defense team further contended that the ganglion cyst had displaced the normal anatomy of the wrist, and, as a result, the tendons were inadvertently transected despite an otherwise careful and successful procedure.  After closing arguments, the jury returned in two and a half hours with a defense verdict in favor of the orthopedic surgeon.
