Chicago: Clausing and Dzik Successfully Defend Obstetrician/Gynecologist Against $2.1 Million Suit Over Surgery Injury

In May 2015, HPS attorneys Marilee Clausing and Kate Dzik secured a victory on behalf of their client, an obstetrician/gynecologist. In the suit, the plaintiff alleged that the physician did not take appropriate steps to protect the ureter during surgery, resulting in injury to the ureter, and requiring life-long stenting.

The patient sought $2.1 million in damages, including economic damages for past and future medical treatment. Clausing and Dzik successfully argued that the injury sustained by the plaintiff was a known and recognized complication of the procedure and could occur even in the absence of negligence by their client.
