Chicago: Hall and Walkup Secure Victory for a Cook County Health Center in Rehabilitation Case
In March 2015, HPS attorneys David Hall
and April Walkup
secured a victory on behalf of their client, a Cook County medical center. The case involved a patient at the medical facility's rehabilitation center who illicitly obtained and ingested a toxic level of anti-anxiety medication during his time in treatment. The combination of the patient's doctor-prescribed medication and the illicitly obtained medication was fatal.
The patient's Estate claimed the hospital failed to enact adequate safeguards and failed to convey relevant clinical information to the treating doctor. They sought $5.7m in damages. Hall and Walkup argued that the hospital was not at fault because the patient had not been addicted to the illicit drugs, did not display any signs or symptoms of an addiction to the drug, and was warned against taking any such drug, but disregarded those warnings.
