Healthcare Litigation Practice Group

The healthcare litigation practice group remains the bedrock of the HPS litigation team. On a per capita basis, this team has tried more cases to verdict in recent years than virtually any of its competitors in the Chicago, Las Vegas, and Salt Lake City markets. The senior partners have tried numerous eight-figure malpractice matters involving brain-damaged infants, neurologically disabled adults and wrongful death claimants. Although HPS gladly handles all healthcare litigation cases, both large and small, its emphasis clearly centers on those involving catastrophic loss. While most of our healthcare litigation cases involve claims of medical negligence, we also handle other healthcare matters involving nursing homes, laboratories, medical products and devices, EMTALA, physician credentialing and privileges, class actions, employment discrimination, and other suits particular to the healthcare industry.

Although HPS has been in existence for a little over five years, many of our senior attorneys have been handling the same type of work for decades while at our predecessor firm, Lord Bissell & Brook. Our attorneys have defended many of the premier self-insured hospitals in the Chicago area, as well as national and local hospital insurance programs and trusts. The group also defends individual physicians, particularly when insured with hospital-based programs.

In addition to our obvious trial emphasis, we routinely counsel various healthcare providers in an effort to minimize their litigation exposure. This counseling includes various commercial and regulatory matters, staff credentialing issues, and the review and drafting of by-laws, policies and procedures.
