HPS Attorneys MSJ Results in Dismissal

Hall Prangle & Schoonveld, LLC attorneys Ana Cazacu, Molly Pankauskas and Jonathon Clark obtained a grant of summary judgment dismissing a suit against a suburban hospital.

After an extensive briefing on the hospital's Motion for Summary Judgment (MSJ), including motion practice for amended pleadings, the Court held that the Plaintiff, who claimed to have slipped and fell while visiting the hospital, failed to demonstrate that the hospital caused or knew of any slippery condition.

Ms. Cazacu, Ms. Pankauskas and Mr. Clark argued that the Plaintiff's own statements contradicted the evidence she relied on. They further argued that the Plaintiff could not identify the foreign substance, which she alleged to have made the floor slippery, or establish any timeframe of its existence.

In addition to the dismissal, the Court also ruled that Plaintiff could not amend her Complaint after additional briefing showed such a request was untimely and unfair to the hospital.
