Nevada: Tyler and Fox Secure Defense Verdict for Hospital Client Against Claim of Unmarked Floor Hazard

In August 2016, HPS attorneys Casey Tyler and James Fox secured a defense verdict on behalf of their client, a Nevada hospital, following a four-day trial. The plaintiff, who was seeking close to $240k in damages, alleged that the hospital had failed to warn her of the presence of wet floor wax on a part of the hallway in the Obstetrics Department. She contended that the lack of any warnings or barriers in place caused her to fall, injuring her knee, wrist, and shoulder.

Chicago: Kane and Lalmalani Successfully Defend Hospital Client Against $2-4M Negligence Claim

The plaintiff sought $2-4M for medical expenses, pain and suffering, and loss of normal life. Kane and Lalmalani denied any negligence on the part of the hospital and argued that the plaintiff’s infection and sepsis were a recognized complication of the distal pancreatectomy. After approximately three hours of deliberation, the jury returned a verdict in favor of the defense.

Nevada: Prangle and Bemis Successfully Defend Hospital Against $1 Million Lawsuit Following a Fall in the Hospital's Bathroom

HPS attorneys Mike Prangle and John Bemis received a Not Guilty verdict earlier this month on behalf of their client, Centennial Hills Hospital. Plaintiff claimed a significant back injury following a fall in a public bathroom within the hospital. Her special damages were in excess of $1 million. Plaintiff claimed the hospital was negligent in failing to timely inspect the bathroom and in failing to discover the presence of spilled water on the floor. After a six-day trial, the jury concluded that there was no negligence, ruling in favor of the Defendant.

Nevada: Webster and Tyler Get Defense Verdict in Clark County

Hall Prangle & Schoonveld’s Casey Tyler and Ken Webster won a jury verdict on October 26 for Sunrise MountainView Hospital, Inc., in a negligence action filed in Clark County District Court (Nevada). On the date of the incident, Plaintiff was working at MountainView when, after a routine surgery, she was transporting dirty instruments to the soiled room on a ring stand that fell apart. As a result, the surgical trays spilled onto the floor, and allegedly caused her to fall and sustain injuries requiring permanent dorsal column nerve stimulator placement and a need for future fusion surgery. Plaintiff argued that the hospital was aware of such an equipment failure and did nothing to address its continued use. Among other allegations was the improper training of students and employees as to the proper methods for transport.

Partner Eric Schoonveld and associate Shelley Doi-Taketa successfully defended a Utah neurosurgeon and hospital against claims that a 48-year-old plaintiff suffered from a DVT after the neurosurgeon performed an anterior lumbar interbody fusion procedure (ALIF). Plaintiff asked the jury for $8.2 million in economic and non-economic damages. After just over three hours of deliberation, the jury returned a no-cause verdict for the defense.
