Plaintiff claimed a significant back injury following a fall in a public bathroom within the hospital. Her special damages were in excess of $1 million. Plaintiff claimed the hospital was negligent in failing to timely inspect the bathroom and in failing to discover the presence of spilled water on the floor. After a six-day trial, the jury concluded that there was no negligence, ruling in favor of the Defendant.

Hall Prangle & Schoonveld’s Casey Tyler and Ken Webster won a jury verdict on October 26 for Sunrise MountainView Hospital, Inc., in a negligence action filed in Clark County District Court (Nevada). On the date of the incident, Plaintiff was working at MountainView when, after a routine surgery, she was transporting dirty instruments to the soiled room on a ring stand that fell apart. As a result, the surgical trays spilled onto the floor, and allegedly caused her to fall and sustain injuries requiring permanent dorsal column nerve stimulator placement and a need for future fusion surgery. Plaintiff argued that the hospital was aware of such an equipment failure and did nothing to address its continued use. Among other allegations was the improper training of students and employees as to the proper methods for transport.
