HPS Secures Two Appellate Victories in Nevada

Congratulations to our Nevada office, which has achieved significant legal victories through two appellate wins.

First, HPS obtained a favorable interpretation of the PSQIA. The team, led by HPS Partner, Nathan Reinmiller, obtained a favorable ruling from the Nevada Supreme Court that the privilege against discovery and disclosure set forth in the Patient Safety and Quality Improvement Act (PSQIA) is absolute and cannot be waived by any party.

Second, HPS was part of an appeal team that recently obtained almost a total reversal of compensatory and punitive damages awards that were premised on plaintiff’s assertion that a hospital owed a fiduciary duty to its patients beyond the normal standard of care required. The Nevada Supreme Court unanimously disagreed and expressly held that a hospital does not owe a fiduciary duty to its patients.
