Kaminski Obtains Dismissal with Prejudice

HPS Partner Matt Kaminski recently obtained a dismissal with prejudice on behalf of a Chicago area hospital client in an employment discrimination case. The case involved allegations by a former registered nurse who alleged that she was unlawfully terminated and retaliated against because she made complaints to her supervisor related to hospital staffing and patient acuity. Matt was able to stay discovery at the outset of the lawsuit, saving the client extensive discovery costs, and successfully argue to the trial court that plaintiff could not state a plausible claim under Supreme Court precedent, warranting dismissal with prejudice of the lawsuit.

Matt is Chair of HPS’ Employment Law Practice. In addition to defending healthcare clients in high-exposure medical malpractice cases and other civil litigation, Matt brings with him almost a decade of experience in employment discrimination litigation. He focuses his employment practice exclusively on defending employers in state and federal court as well as the administrative agencies at the city, state, and federal level. In these different forums, Matt litigates cases involving including race, gender, sex, and disability discrimination; harassment; retaliation; whistleblowing; and wage and hour disputes. The intersection of Matt’s employment law practice defending healthcare systems and his defense of healthcare systems against medical malpractice lawsuits allows him to provide valuable insight to healthcare systems as they navigate through complex employment-related legal issues.
