This event is a follow-up to a presentation that Ann and Laura gave on Telehealth on Friday, November 20, 2020, for the Chicago Healthcare Risk Management Society’s annual Patient Safety Day.
On November 20, 2020, Ann discussed the definition, history of telehealth as well as the past, current and projected government regulations regarding telehealth.
Telehealth refers to a range of medical care that can be delivered through telephone, internet video, audio, email, and mobile platforms (apps).
The broadest regulatory concept for telehealth is that any service, provided through telehealth, must conform to the current standers of care and be able to provide the same level of care as a traditional, in-person appointment.
Since the outbreak of the COIVD-19 pandemic, healthcare providers have increasingly used telehealth to care for their patients.
The Federal and State oversight bodies have relaxed some regulations to allow providers to care for their patients more quickly and safely.
Laura delved into the current and potential litigation risks that providers might face when working through telehealth.
The liabilities that providers face are, to some extent, unknown due to the modernity of the use of Telehealth.
Providers could face all the medical malpractice accusations that in-person caregivers face because the baseline standard for telehealth is that it should produce the same level of care as an in-person visit.
Current data indicates that the most common type of accusations against telehealth providers are claims of misdiagnosis.
