Working as co-trial counsel with attorneys Elizabeth Bruer and Shannon Buckley from Swanson, Martin & Bell, HPS partner David Hall recently obtained a not liable verdict on behalf of an obstetrician and Duly Health (Formerly DuPage Medical Group). This DuPage County trial involved the death of a one-day old infant who suffered from a skull fracture, major bleed, placental infection and had been born very depressed and difficult to resuscitate. Significantly, the mother acknowledged having taken illicit drugs and consumed alcohol daily for the first four months of the pregnancy before realizing she was pregnant.

The Plaintiff asked for $10M at the time of closing. After deliberating, the jury returned a not liable verdict. The co-defendant hospital, who was in the case primarily for agency for our obstetrician, was also part of the defense verdict.
