HPS Attorneys Obtained Directed Verdict in Cook County

HPS attorneys Eric Schoonveld, Gina Ambrose, and Isabella Shindler obtained a directed verdict in favor of Defendants in a recent Cook County trial for a suburban hospital and its nurse. Co-Defendants included an emergency medicine physician, who was an alleged agent of the hospital.

This medical negligence case involved allegations of Defendants’ alleged failure to evaluate and failure to hold a patient against her will, and an alleged inappropriate discharge after the patient left against medical advice. After the patient was discharged against medical advice, she fell off the third story of the nearby parking garage where she sustained injuries from her fall.

After two weeks of Plaintiff’s case-in-chief, a directed verdict was entered in favor of Defendants due to Plaintiff’s inability to provide expert testimony regarding standard of care criticisms against Defendants, as well as the failure to provide expert evidence of any causal link to the patient’s injuries. Thus, judgment was entered in favor of Defendants before any evidence for the defense was put before the jury.
