HPS Attorneys Obtained a Defense Verdict in Cook County

HPS Attorneys Laura Ginett, Elizabeth Neidig, and Molly Pankauskas obtained a defense verdict in a recent Cook County trial involving a Chicago hospital and a co-defendant general surgeon, alleged to be an agent and apparent agent of the hospital.
The case involved the 49-year-old plaintiff who underwent a hemorrhoidectomy surgery performed by the co-defendant surgeon. The plaintiff claimed that the surgery was performed negligently and outside the scope of informed consent provided. Additionally, the plaintiff alleged the hospital was negligent in credentialing the surgeon, failed to implement and train the co-defendant surgeon on an informed consent policy, and didn’t adequately train the co-defendant surgeon on proper opioid prescription practices.
At trial, Ginett and Neidig obtained directed verdicts on the institutional negligence and actual agency claims. The plaintiff requested $61.6 Million from the jury for pain, suffering, and loss of a normal life from the surgeon and hospital based on apparent agency claims. Ultimately, the jury returned a unanimous verdict in favor of the defendants on the apparent agency allegations and for the co-defendant surgeon.
